What is a FMC license?

The Federal Maritime Commission (FMC) is the U.S. regulator for international container ocean transport to/from the United States. It issues licenses to Ocean Transportation Intermediaries (OTIs); ocean freight forwarders and NVOCCs. Besides that, the authority also maintains financial responsibility.

 

Who needs an FMC license or registration?

  • U.S.-based OTIs (forwarders/NVOCCs): require an FMC license and financial responsibility.

  • Non-U.S. NVOCCs: do not need a license, but must register with the FMC and post financial responsibility.

Financial responsibility (bond) amounts

  • Ocean freight forwarder: USD 50,000

  • NVOCC (U.S.-based or licensed non-U.S.): USD 75,000

  • NVOCC (non-U.S., registered but unlicensed): USD 150,000

Other key obligations

  • Maintain a public tariff and a valid bond; U.S.-based NVOCCs also need a license.

  • NVOCC Negotiated Rate Arrangements (NRAs) may be used under Part 532 of the FMC regulations.

OSRA: why it matters

The Ocean Shipping Reform Act (OSRA) 2022 expanded FMC oversight, notably on detention & demurrage and carrier/OTI practices. The FMC provides a living implementation record and has increased enforcement since OSRA’s passage.
